Halle Berry and her ex-husband Olivier Martinez are back in court over the custody of their 12-year-old son, Maceo.
A Los Angeles County judge granted Martinez a temporary restraining order against Berry on October 1 after he accused the actress of physically abusing their son during an alleged incident on September 26.
Martinez claims Berry jumped on Maceo, placed her hands around his neck and choked him during an argument. He is also seeking sole custody.
Berry’s attorney strongly denies the allegations and has described Martinez’s claims as misleading and without merit.
The temporary order modifies Berry’s parenting time while the case is being reviewed. She is currently allowed daytime visits with Maceo on specified weekdays and alternating weekends.
The judge denied Martinez’s request to require Berry to undergo sobriety monitoring, saying there was not enough information to support that request.
Berry has also filed court documents asking to restore their previous joint custody arrangement. She claims Maceo often returns from his father’s home angry with her and has accused Martinez of negatively influencing their son’s relationship with her.
The former couple has been involved in a difficult co-parenting relationship for years. Their divorce was finalized in 2023 after they separated in 2015.
A hearing is scheduled for October 16, when the court will consider what happens next with the temporary order and custody arrangement.
For now, the allegations against Berry remain allegations and have not been proven in court.
