Halle Berry Faces Temporary Restraining Order In Custody Dispute With Ex Olivier Martinez

A Los Angeles County judge granted Olivier Martinez a temporary restraining order against his ex-wife Halle Berry on Thursday (October 1), temporarily restricting her visitation with their 12-year-old son, Maceo.

The order follows allegations from Martinez that Berry physically abused their son during an incident on September 26. The allegations have not been established in court.

According to court documents obtained by PEOPLE, Martinez alleged that Berry put her hands around Maceo’s neck and choked him during an argument. He is seeking sole custody of their son.

The judge did not completely suspend Berry’s contact with Maceo. Her visits will continue twice during the week and every other weekend, with the temporary order remaining in place until a hearing on October 16.

The judge also declined Martinez’s request to have Berry’s sobriety monitored, citing insufficient information.

Berry’s attorney, Marina Beck, strongly disputed Martinez’s account, calling the filing “entirely meritless and deliberately misleading.”

 Beck also said Martinez has previously violated court orders and interfered with therapeutic and educational interventions involving their son.

The latest dispute comes after years of challenges in the former couple’s co-parenting relationship. According to PEOPLE, Berry and Martinez were ordered to participate in co-parenting therapy in 2024 to address disputes and conflicts. 

The process included individual meetings and six joint sessions, according to court documents. Berry’s fiancé, musician Van Hunt, was also permitted to participate.

Berry and Martinez finalized their divorce in 2023 after years of proceedings and share joint legal custody of Maceo.

The former couple has also been ordered to participate in mediation on October 14, two days before the next restraining-order hearing.
